Acknowledgment

These Terms and Conditions govern your use of the Service and form the agreement between you and the Company. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part, you may not use the Service. Your use is also subject to our Privacy Policy.

Software License

The macprefs Software is proprietary, closed-source software owned by the Company and protected by copyright and other laws. Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software free of charge for your personal or internal business purposes.

You may not, except as permitted by applicable law:

All rights not expressly granted are reserved by the Company. The Software is provided "AS IS" without warranty of any kind, as further described below.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors, protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

Your Feedback

You assign to the Company all rights in any feedback or suggestions you provide about the Service. If that assignment is ineffective, you grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use such feedback without restriction.

Links to Other Sites

The Service may contain links to third-party sites not controlled by the Company. We assume no responsibility for their content or practices and advise you to review their terms and policies.

Termination

We may terminate or suspend your access immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases and the license granted above terminates.

Limitation of Liability

To the maximum extent permitted by law, the Company's total liability under these Terms is limited to USD 100. In no event shall the Company be liable for any special, incidental, indirect, or consequential damages, even if advised of the possibility. Some jurisdictions do not allow these limitations, in which case they apply to the greatest extent permitted.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" with all faults and without warranty of any kind. To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

Governing Law

The laws of Georgia, United States, excluding its conflict-of-law rules, govern these Terms and your use of the Service.

Disputes

If you have any dispute about the Service, you agree to first try to resolve it informally by contacting the Company.

United States Legal Compliance

You represent that you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and that you are not on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, it will be modified to achieve its intent to the greatest extent possible, and the remaining provisions remain in effect. Failure to enforce a right is not a waiver of it.

Changes to These Terms

We may modify these Terms at any time. For material changes we will make reasonable efforts to provide notice. Continuing to use the Service after changes take effect constitutes acceptance.
